This is a translation. The Polish version (Regulamin) is legally binding.

§ 1. General provisions

  1. These terms of use (the "Terms") govern the use of the ciapp application and of the Account Deletion Page. They constitute terms of service within the meaning of Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
  2. The Service Provider is Radosław Gajewski, e-mail: radoslawgajewskii@gmail.com. This address is also the single point of contact for recipients of the service and for the authorities of the Member States, the European Commission and the European Board for Digital Services under Articles 11 and 12 of Regulation (EU) 2022/2065 of the European Parliament and of the Council (the Digital Services Act, the "DSA"). Communication may be in Polish or English.
  3. The Service is free of charge. It contains no advertising and no in-app payments.
  4. The processing of personal data is governed by the Privacy Policy.
  5. These Terms are made available free of charge at this address in a form that allows them to be obtained, reproduced and stored, including saved and printed.

§ 2. Definitions

In these Terms:

  1. Service Provider means Radosław Gajewski, as identified in § 1(2).
  2. App means the ciapp application for Android and Windows.
  3. Account Deletion Page means the web page that allows an Account to be deleted without using the App.
  4. Service means the services supplied electronically by the Service Provider through the App and the Account Deletion Page.
  5. User means a natural person aged 16 or over who uses the Service.
  6. Account means a User's individual account in the Service.
  7. Content means any content entered into the Service by a User, in particular events, notes, to-dos and messages.
  8. Agreement means the agreement for the provision of the Service concluded between the Service Provider and a User on the basis of these Terms.

§ 3. Nature and scope of the Service

Under the Service, the Service Provider makes the following available to the User:

  1. an Account;
  2. an event calendar with reminders and a school timetable;
  3. notes and to-dos;
  4. friends and groups, with which events and notes can be shared;
  5. end-to-end encrypted chat with friends and in groups;
  6. blocking and reporting of other users;
  7. downloading a copy of the User's data and deleting the Account.

§ 4. Technical requirements and risks

  1. Use of the Service requires a device running Android 7.0 or later with Android System WebView 111 or later, or a computer running 64-bit Windows 10 or 11; internet access; and an e-mail address or a Google account.
  2. The Windows App is available at rgdev.pl/apps/ciapp and the Android App on Google Play.
  3. The use of electronically supplied services involves typical risks, such as malware or phishing attempts. The Service Provider recommends keeping the operating system up to date and obtaining the App only from the sources listed in paragraph 2.

§ 5. Conclusion and termination of the Agreement

  1. Only persons aged 16 or over may use the Service.
  2. The Agreement is concluded for an indefinite period upon creation of an Account.
  3. The User may terminate the Agreement at any time, without giving reasons and at no cost, by deleting the Account in the App (Settings → Account) or as described on the account deletion page.
  4. The User must keep the Account password and the chat password confidential. The Service Provider does not know the chat password and cannot recover it; without it, earlier messages cannot be read on a new device.
  5. The Account is personal. The User must not share it with third parties.

§ 6. Rules of use

  1. It is prohibited to provide unlawful content through the Service, in particular content that harasses or threatens, incites hatred or violence, infringes the rights of third parties (including privacy rights and copyright) or depicts child sexual abuse, as well as to send spam or impersonate other persons.
  2. It is prohibited to interfere with the operation of the Service or to attempt to gain unauthorised access to other Users' Accounts or data.

§ 7. Notices and content moderation

  1. In the App, a User may block any other user and report a user or a message.
  2. Any person may report illegal content by sending a notice to radoslawgajewskii@gmail.com. The notice should contain an explanation of why the content is considered illegal, the exact location of the content, the name and e-mail address of the person submitting the notice, and a statement that the notice is submitted in good faith (Article 16 DSA).
  3. Notices are processed without undue delay by the Service Provider in person; no automated moderation tools are used. Because the chat is end-to-end encrypted, the Service Provider can see only messages that have been reported to it.
  4. In the event of a breach of these Terms or of the law, the Service Provider may remove content, suspend the Account, or delete the Account and terminate the Agreement with immediate effect. The Service Provider will inform the User of the decision and the reasons for it by electronic means, unless prohibited by law (Article 17 DSA).
  5. The User may appeal against a decision referred to in paragraph 4 by writing to radoslawgajewskii@gmail.com. The Service Provider decides on the appeal within 14 days of its receipt.
  6. Where content gives rise to a suspicion of a criminal offence involving a threat to the life or safety of persons, the Service Provider may notify the competent authorities (Article 18 DSA).

§ 8. User Content

  1. The User retains the rights to the Content the User enters and is responsible for it.
  2. The User grants the Service Provider a non-exclusive, royalty-free licence to store and process the Content and to display it to the persons with whom the User has shared it, solely to the extent necessary to provide the Service. The licence expires upon deletion of the relevant Content or of the Account.

§ 9. App licence

  1. All rights in the App, its name and logo belong to the Service Provider. The Service Provider grants the User a free-of-charge, non-exclusive and non-transferable licence to install the App on the User's devices and to use it for personal purposes for the term of the Agreement.
  2. It is prohibited to sell the App, distribute it outside the official sources, modify it or introduce malicious code into it. This provision does not limit any rights that cannot be excluded by contract, in particular those under Article 75 of the Polish Act of 4 February 1994 on Copyright and Related Rights.

§ 10. Availability and liability

  1. The Service is provided free of charge and on an "as is" basis. The Service Provider endeavours to ensure that the Service operates continuously but does not warrant its uninterrupted availability or that it is free of errors. The Service Provider may temporarily suspend the Service, in particular for maintenance or security reasons.
  2. Reminders and notifications are provided for convenience only. The device's operating system may delay or suppress them, for example in battery saver mode. They must not be relied upon where a delay could cause harm, for example for taking medication. The Service is not intended for emergency communication.
  3. The Service Provider recommends downloading a copy of the User's data regularly (Settings → Data copy). The Service Provider is not liable for the loss of messages resulting from the loss of the chat password or of a device.
  4. To the fullest extent permitted by law, the Service Provider is not liable for damage resulting from interruptions of the Service, loss of data, Content added by other users or the operation of third-party services (such as Google, network operators or device manufacturers). Nothing in these Terms excludes or limits the Service Provider's liability for damage caused intentionally, for personal injury, or in any other case where such exclusion or limitation is not permitted by law.
  5. These Terms do not exclude or limit any rights of consumers under mandatory provisions of law.

§ 11. Termination by the Service Provider

  1. The Service Provider may discontinue the Service or terminate the Agreement for good cause by giving at least 30 days' notice. The Service Provider will notify the User in the App or by electronic means, so that the User can download a copy of the User's data.
  2. In the event of a serious breach of these Terms or of the law, the Service Provider may terminate the Agreement with immediate effect in accordance with § 7(4).

§ 12. Complaints

  1. Complaints concerning the Service should be sent to radoslawgajewskii@gmail.com.
  2. A complaint should include a description of the problem and the e-mail address associated with the Account.
  3. The Service Provider handles complaints within 14 days of receipt and responds by electronic means.

§ 13. Out-of-court dispute resolution

A User who is a consumer may use out-of-court complaint and redress procedures, in particular by seeking assistance from a municipal or district consumer ombudsman (rzecznik konsumentów) or from a consumer protection organisation. Further information is available on the website of the Polish Office of Competition and Consumer Protection (uokik.gov.pl).

§ 14. Amendments to the Terms

  1. The Service Provider may amend these Terms for good cause, in particular changes in the law, the introduction of new features or security considerations.
  2. The Service Provider will announce amendments in the App or on this page at least 14 days before they take effect.
  3. A User who does not accept the amendments may terminate the Agreement by deleting the Account before they take effect.

§ 15. Final provisions

  1. These Terms are governed by Polish law. This choice of law does not deprive a consumer of the protection afforded by the mandatory provisions of the law of the country of the consumer's habitual residence.
  2. The English version of these Terms is a translation. In the event of any discrepancy, the Polish version prevails.
  3. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force.
